BAHRIA TOWN UNDERTAKING FORMAT

UNDERTAKING AND INDEMNITY BOND.

THIS UNDERTAKING   AND   INDEMNITY   BOND   dated________________________________, made by and

BETWEEN.

I,_____________________________________/of_____________________________holding C.N.I.C  No.__________________________ resident of _____________________________________________________________________________________________ (hereinafter referred to”Seller”).

AND

I,_____________________________________/of_____________________________holding C.N.I.C  No.__________________________ resident of _____________________________________________________________________________________________ (hereinafter referred to”Seller”).

Whereas, Seller and Purchaser may be collectively referred to as the “Parties” or individually as a “Party”

Whereas, Seller is absolute owner of Registration No.___________in Project_________________ and has sold said its registration number to the Purchaser with all rights, obligations and liabilities thereupon.

Now, therefore, both parties above named to hereby solemnly affirm, undertake and declare as under:-

1. We agree to abide by and adhere to all instructions regarding the above said registration number, whether posted in writing or advised verbally by the Bahria Town (Pvt.) Ltd.
2. We, also hereby undertake and agree, to hold harmless Bahria Town (Pvt.) Ltd, its respective directors, officers, administrators, employees, agents, representatives, volunteers, independent contractors and affiliated persons and entitles from all liability, claims, demands, losses or damages caused or alleged in whole or in part by any act of omission of arising out the said transaction of sale purchase in connection with the said registration number or otherwise, even if the Parties are unintentionally at fault for such act or omission.
3. We, agree to indemnity and keep indemnified and saved, harmless Bahria Town (Pvt.) Ltd, its participants and Beneficial Owners of, from and against (i) any harm, loss damage or injury (ii) any claim or demand and (iii) any suit, action, litigation or other proceedings whatsoever, that the Bahria Town (Pvt.) Ltd. And/or its Participants and/or Beneficial Owners may suffer or incur or  may be called upon to suffer or incur (including all costs, charges and expenses incurred or required to be injured on prosecuting or defending any suit, action litigation and/or proceedings).
4. In any circumstances, whatever we have stated above, we shall not revoke/challenge the same before any forum.
