GIFT DEED

This Gift Deed is made at _________________This _____________ day of ___________.

BETWEEN

Mr._________________________________ S/o _____________________________ , Muslim,  Adult, Holding C.N.I.C No. _________________________________ Resident of ____________________________________________________________ hereinafter called DONOR (Which expression shall whenever the context so permits means and include her heirs, executors, administrators and assign) of the FIRST PART.

AND

Mr._________________________________ S/o _____________________________ , Muslim,  Adult, Holding C.N.I.C No. _________________________________ Resident of ___________________________________________________________________ hereinafter called DONEE (Which expression shall whenever the context so permits means and include her heirs, executors, Successors and assigns) of the OTHER PART.

WHEREAS the DONOR above named is at the date of these presents seized and possessed of and is otherwise well and sufficiently entitled of House No. ___________, measuring _________________ Sq. Yards , situated in _______________________________

And WHEREAS the DONOR in consideration to her love and affection for the done who are his/ here Real Son/ Daughter had voluntarily in all senses, understanding of the situation, without duress, coercion, threat or pressure of any kind orally gifted, donated, given, made HIDA/GIFT the above mentioned property to the DONEE in accordance with the Mohammadan Law in presence of the witnesses: on ________________ day of _______________________________ at Karachi. The said ORAL GIFT/HIBA was voluntarily declared by the DONOR and was accepted by the DONEE.

AND WHEREAS it was expedient and necessary t record the same to avoid any complication, litigation and all future doubts and misunderstanding among the member of family and also from the minds of interested persons.

HENCE THIS DECLARATION OF GIFT WITNESSETH AS UNDER:

1. of the Oral Gift the DONEE are in possession of the aforesaid That the DONOR above named had given, granted, donated gifted and made a HIBA of the aforesaid property (more specially described in schedule) to the done in consideration of love and affection according to the muhammadan law before the witnesses mentioned above.
2. That at the time of pronouncement of this Gift the DONOR has handed over the Physical possession of the said property to the done above named and they have taken over the physical possession. All the title documents in original of the said property and every other documents related to the said property has also been handed over to the DONEE by the DONOR at the time of the said gift.
3. That from the day of the pronouncement property as owner and that the DONOR has divested herself completely from the dominion of the subject of the Gift and the DONOR has no right, title or claim in the said Gifted Property.
4. That from the day of the Gift the DONEE is the absolute and exclusive owner of the said property having all rights title and claims of whatsoever nature.
5. That the said gifted property is free from all encumbrance lienes, charges, claims, etc. of whatsoever nature till the date of this gift to the DONEE above named the DONOR has already by way of Gift transferred all her rights, title and interests in the said property.

6. That henceforth the DONEE shall be rightful and absolute owner of the said gifted property and shall peacefully have, holds, occupy, possess, dispose it is any manner and enjoy all rights, title and emoluments therein without any let, claims, demands, denial, hindrance or interruption by the DONOR or any other person/persons.

IN WITNESSES WHEREOF the DONOR has set and subscribed her respective hands to this declaration in this presence of the under mentioned two witnesses at Karachi on the dated ____________ mentioned above.
